We DO NOT collect or store any of the data you enter in the iOS app. We DO store data you voluntarily provide us on our website, such as your name or email address via our signup form, which is used solely for the purpose of communicating with you. We DO NOT sell such information to third parties.

The Ugh, Budgets iOS app stores all budget data on your device using local device storage, and your iCloud for syncing between your Apple devices (which we cannot access). We do not collect, transmit, or store any personal information or your budget data from the iOS app on other third party servers, or even our own.

We will retain any personal information you provide us only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our policies.

Data Security

The security of your data is important to us, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. For this reason, our mobile app collects and transmits no information to us or to any third-party servers beyond the scope already expressed in this Privacy Policy.

Additional human context: The Service is provided for personal project budgeting and planning use. The app is offered "as is" without warranty of any kind. We are not liable for any financial decisions made based on information entered into or generated by the app.

You are responsible for maintaining backups of your data in the app. The app's export feature is provided as a convenience, and changes to third party services may render exported data unable to be used. We are not responsible for data loss resulting from device failure, app deletion, or use of the Hard Reset feature of the app. This website has no live data connectivity to the app.

Indemnification

You agree to defend, indemnify, and hold harmless Around the FIYA Inc., its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, Your Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service, or because of errors that occur outside of its jurisdiction or domain, such as Apple iCloud services..

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AROUND THE FIYA INC. SPECIFICALLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE. WE DON'T PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

YOUR USE OF THE SERVICE AND ANY CONTENT OBTAINED THROUGH THE SERVICE IS AT YOUR OWN RISK. WE DON'T GUARANTEE THAT THE SERVICE OR ANY CONTENT WILL BE ACCURATE, RELIABLE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THIS IS A FUNDAMENTAL PART OF OUR AGREEMENT WITH YOU.

Dispute Resolution: Arbitration and Class Action Waiver

Mandatory Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in the United States. The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (the "AAA Rules") then in effect, except as modified by this Section or agreed upon by all parties.

The arbitration will be conducted by a single, neutral arbitrator. The arbitration will take place in the state where Around the FIYA Inc. is incorporated, unless you and Around the FIYA agree otherwise. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Class Action Waiver

YOU AND AROUND THE FIYA INC. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Around the FIYA agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

This means you're giving up your right to participate in a class action lawsuit. It's an important point to understand.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or other tribunal of competent jurisdiction, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect. This ensures that the rest of the agreement still stands, even if one part doesn't.

Governing Law (EU Users)

For users in the European Union, these Terms shall be governed by and construed in accordance with applicable EU laws. Nothing in these Terms shall affect your statutory rights as a consumer under applicable EU consumer protection legislation.

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Around the FIYA Inc. operates, without regard to its conflict of law provisions.

Around the FIYA Inc. is under the jurisdiction of United States law. Please abide by all applicable laws in your locale, and all applicable international laws. By using the app you agree not to use it for planning any illegal activities or executing any nefarious plots to take portions of other nations' land.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
